    Foreclosure is a legal process in which a lender attempts to recover the balance of a loan from a borrower who has stopped making payments to the lender. This is done by forcing the sale of the asset/property used as the collateral for the loan. Maryland is a Judicial State. Judicial sales are conducted under an order, supervision or direction of the Circuit Court. The court ordered auction sales must be ratified by the court. Washington, DC is both a judicial and non-judicial jurisdiction. Judicial sales are conducted under an order of the Superior Court and must be ratified by the court. Condominium assessment foreclosures are non-judicial where the condominium association attempts to recover for unpaid condominium dues.
